Welcome to KropDuster.com (“Website”), owned and operated by KropDuster Genetics. (“KropDuster,” “we,” “us,” or “our”), a company incorporated under the laws of British Columbia, Canada. These Terms and Conditions (“Terms”) govern your access to and use of the Website, including any purchase of hemp seeds or related products (“Products”). By accessing or using the Website, or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use the Website or purchase Products.

1. Eligibility You must be at least 21 years of age and capable of forming a legally binding contract to use this Website or purchase Products. By using the Website, you represent and warrant that you meet these requirements and are not purchasing Products for any illegal purpose.

2. Product Description and Use

  • Hemp Seeds: All seeds sold on KropDuster.com are low-THC hemp seeds compliant with the Cannabis Act (Canada) and applicable regulations. Seeds are sold for lawful purposes, such as agricultural cultivation under a valid license, research, or as collectibles/souvenirs where permitted.
  • No Guarantee of Germination: KropDuster does not guarantee seed germination rates, as germination may be restricted or illegal in your jurisdiction. You are responsible for ensuring compliance with local laws regarding seed use.
  • International Orders: Exporting hemp seeds may violate laws in your country (e.g., US federal law under the Controlled Substances Act). You assume full responsibility for ensuring that importing, possessing, or using the Products complies with all applicable laws in your jurisdiction. KropDuster is not liable for seized, confiscated, or destroyed shipments due to customs or legal violations.

3. Orders and Payment

  • Order Acceptance: All orders are subject to acceptance by KropDuster. We reserve the right to refuse or cancel any order for any reason, including product availability, pricing errors, or suspected violation of these Terms.
  • Pricing and Taxes: Prices are listed in US Dollars (USD) unless otherwise stated. You are responsible for any applicable taxes, duties, or customs fees, including those imposed by your local jurisdiction.
  • Payment: We accept payments via Crypto Currency. You represent that you are authorized to use the payment method provided and that all payment information is accurate.
  • Refunds and Returns: Refunds are issued at our discretion, subject to our Refund Policy. Non-delivery due to customs seizure does not automatically entitle you to a refund, as you assume import risks (see Section 2). Contact us at support@kropduster.com within 30 days of order placement for replacement inquiries.

4. Shipping and Delivery

  • Shipping: We ship to addresses provided by you. You are responsible for ensuring accuracy of shipping information. KropDuster is not liable for delays, losses, or seizures by customs or other authorities.
  • Risk of Loss: Risk of loss and title for Products pass to you upon delivery to the carrier. For international orders, you bear all risks related to customs clearance or legal restrictions.
  • Stealth Packaging: Where offered, stealth packaging is provided as a courtesy and does not guarantee successful delivery or avoidance of customs seizure.

5. Intellectual Property

All content on the Website, including text, images, logos, and product descriptions, is the property of KropDuster or its licensors and is protected by Canadian and international copyright laws. You may not reproduce, distribute, or modify any content without our prior written consent.

6. Disclaimers and Limitation of Liability

  • As-Is Products: Products are sold “as is” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement, to the fullest extent permitted by law.
  • No Liability for Illegal Use: KropDuster is not liable for any damages, fines, or penalties arising from your use of Products in violation of local, national, or international laws.
  • Limitation of Liability: To the maximum extent permitted by law, KropDuster’s total liability for any claim arising out of or relating to these Terms or the Products shall not exceed the amount paid by you for the Products. We are not liable for indirect, incidental, consequential, or punitive damages, including loss of profits or data.

7. Governing Law

These Terms and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to its conflict of laws principles.

8. Dispute Resolution and Arbitration

  • 8.1 Agreement to Arbitrate: Any dispute, controversy, or claim arising out of or relating to these Terms, the Website, or the purchase or use of Products (including without limitation any shipment, delivery, or customs-related issues), or the breach, termination, enforcement, interpretation, or validity thereof (collectively, “Disputes”), shall be resolved exclusively through final and binding arbitration, rather than in court, except that you may assert claims in small claims court if your claims qualify and are within the court’s jurisdictional limit.
  • 8.2 Arbitration Rules and Procedures: The arbitration shall be administered by the ADR Institute of Canada (ADRIC) under its Commercial Arbitration Rules in effect at the time the Dispute is submitted. The arbitration shall be conducted in Vancouver, British Columbia, Canada, by one arbitrator mutually agreed upon by the parties or appointed by ADRIC if the parties cannot agree. The language of the arbitration shall be English. Judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction thereof.
  • 8.3 No Class Actions: You and KropDuster agree that Disputes shall be arbitrated on an individual basis. Neither you nor KropDuster may seek to bring or join any class, collective, or representative action in arbitration or otherwise, and the arbitrator shall have no authority to hear or preside over any such action.
  • 8.4 Jurisdiction and Venue: For any non-arbitrable matters or for enforcement of an arbitration award, you and KropDuster irrevocably submit to the exclusive jurisdiction of the courts of the Province of British Columbia sitting in Vancouver. You waive any objection to such jurisdiction or venue, including on grounds of inconvenient forum.
  • 8.5 Costs and Fees: Each party shall bear its own costs and attorneys’ fees in any arbitration or court proceeding, unless the arbitrator awards otherwise as permitted by law.

9. Indemnification

You agree to indemnify, defend, and hold harmless KropDuster, its affiliates, officers, directors, and employees from any claims, liabilities, damages, or expenses (including reasonable attorneys’ fees) arising from your use of the Website or Products, violation of these Terms, or violation of any applicable laws.

10. Privacy

Your use of the Website is subject to our Privacy Policy https://kropduster.com/privacy-policy/, which describes how we collect, use, and protect your personal information.

11. Termination

We may terminate or suspend your access to the Website at our sole discretion, without notice, for any reason, including suspected violation of these Terms or illegal activity. Sections 6–9 and 11–12 survive termination.

12. Miscellaneous

  • Entire Agreement: These Terms, together with the Privacy Policy and any other policies referenced, constitute the entire agreement between you and KropDuster regarding the Website and Products.
  • Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
  • No Waiver: Our failure to enforce any right or provision does not constitute a waiver of such right or provision.
  • Assignment: You may not assign your rights or obligations under these Terms without our prior written consent. KropDuster may assign its rights and obligations at any time.
  • Force Majeure: KropDuster is not liable for delays or failures to perform due to causes beyond our reasonable control, such as natural disasters, government actions, or customs seizures.
